Disgraced City Court Judge Leticia Astacio was back in court for a pre-trial hearing.
Astacio tried to buy a gun back in April and the other violation is for failing to go through with mental health treatment.
Her attorney, Mark Foti, argues that NYS law does not consider an unloaded shotgun a "deadly or dangerous weapon."
Astacio is appealing the Commission on Judicial Conduct's decision to remove her from the bench.
Her case will be heard in Albany on Sept. 5.
